Guarantee & Returns Policy
Our voluntary 30-day guarantee, your rights under EU consumer law, and how returns work in the European Union.
1. Our Guarantee
BRUTEforce® Australia offers a 30-Day Money Back Guarantee on eligible purchases made directly from BRUTEforce® Australia.
This is a voluntary change-of-mind return policy provided in addition to your legal rights.
Consumers purchasing online or through another eligible distance contract may also have a separate 14-day statutory right of withdrawal.
Consumers also have separate mandatory rights where goods are faulty, damaged, incorrect or otherwise do not conform to the contract.
These rights are separate.
The 15% restocking fee applicable to eligible voluntary returns does not apply merely because a consumer exercises the statutory 14-day right of withdrawal and does not apply to a mandatory legal remedy for faulty or nonconforming goods.
2. Statutory 14-Day Right of Withdrawal
If you are a consumer purchasing through an eligible distance contract, including an eligible online purchase, you generally have the right to withdraw from the contract within 14 days without giving a reason, subject to applicable exceptions.
For goods, the withdrawal period generally expires 14 days after the day on which you, or a third party nominated by you other than the carrier, acquire physical possession of the goods.
Where an order contains multiple goods delivered separately, or goods consisting of multiple lots or pieces delivered separately, the applicable withdrawal period will be determined in accordance with applicable law.
Where mandatory national law provides greater protection, that law will apply.
3. How to Exercise Your Right of Withdrawal
To exercise the statutory right of withdrawal, you must inform BRUTEforce® Australia of your decision to withdraw by an unequivocal statement before the withdrawal period expires.

You may use the Model Withdrawal Form contained in this Policy, but use of the form is optional.
BRUTEforce® may provide an RMA or return reference to assist with identification and processing.
An RMA is an administrative procedure for a statutory withdrawal and is not a discretionary approval condition that removes or restricts the statutory right.
4. Returning Goods After Withdrawal
Unless BRUTEforce® has agreed to collect the goods, you must return or hand over the goods without undue delay and generally no later than 14 days after informing us of your decision to withdraw, subject to applicable law.
Because BRUTEforce® products can be large, heavy and palletised, please contact us before arranging return freight.
Products originally supplied on a pallet or in a heavy-duty crate should be appropriately secured for return transportation.
Goods should be packaged sufficiently to protect them against avoidable transportation damage.
5. Cost of Returning Large or Heavy Goods
Where permitted by applicable law and where you have been properly informed before entering into the contract, you are responsible for the direct cost of returning goods when exercising the statutory right of withdrawal.
Many BRUTEforce® products, including functional trainers and other large fitness equipment, cannot normally be returned by post.
They may require specialised freight, palletisation and suitable collection arrangements.
Based on BRUTEforce® delivery costs experienced to date, the estimated cost of return freight for large or palletised BRUTEforce® equipment is approximately €197–€684, depending on the collection location, product, weight, dimensions and freight requirements.
This is an estimate. Actual return freight costs may vary according to the circumstances of the return and collection location.
Where BRUTEforce® arranges return freight on your behalf, we will advise you of the applicable freight cost. Where permitted by law, that cost may be payable by you or deducted from the amount otherwise refundable.
Where BRUTEforce® is legally required to bear the return cost, BRUTEforce® will do so.
6. No 15% Restocking Fee for Statutory Withdrawal
The BRUTEforce® 15% restocking fee does not apply simply because you exercise your statutory 14-day right of withdrawal.
The 15% restocking fee applies only to eligible change-of-mind returns under our separate voluntary 30-Day Money Back Guarantee.
A statutory withdrawal may nevertheless be subject to a lawful diminished-value assessment where the goods have been handled beyond what was necessary to establish their nature, characteristics and functioning.
7. Inspection, Assembly, Use & Diminished Value
You may inspect and handle goods to the extent reasonably necessary to establish their nature, characteristics and functioning.
You may be responsible for diminished value resulting from handling beyond what was necessary for that purpose, where permitted by applicable law.
For large and complex fitness equipment, handling beyond what is reasonably necessary may, depending on the circumstances, include:
Full or substantial assembly beyond what was reasonably necessary for inspection.
Using equipment for workouts, repeated training or extended exercise testing.
Causing scratches, dents, marks, chips or other damage.
Causing unnecessary wear to upholstery, cables, pulleys, grips, rollers or other components.
Removing protective materials where removal was not reasonably necessary.
Discarding or materially damaging packaging where this causes an actual reduction in value.
Modifying, drilling, cutting or altering the product.
Permanently installing components.
Causing deterioration through incorrect assembly, handling, storage or use.
Returning equipment incomplete or without supplied components or accessories.
Opening packaging does not, by itself, remove your statutory right of withdrawal.
Assembly or use does not automatically result in a fixed deduction.
Any lawful diminished-value deduction will be based on the actual circumstances, condition of the returned goods and actual reduction in value reasonably attributable to excessive handling.
The 15% voluntary restocking fee will not be substituted for this assessment.
8. Original Packaging
We strongly recommend retaining the original packaging, protective materials, crate and pallet until you have decided whether to keep your equipment.
Opening the packaging does not by itself remove the statutory withdrawal right.
Original packaging is particularly useful for safely transporting large and heavy equipment.
Where packaging is discarded or materially damaged and this results in an actual reduction in value because of handling beyond what was reasonably necessary, that may be taken into account where permitted by applicable law.
9. Statutory Withdrawal Refunds
Where you validly exercise the statutory right of withdrawal, BRUTEforce® will reimburse payments as required by applicable law.
This will generally include the purchase price and the cost of the least expensive standard delivery option offered for the order.
If you selected a more expensive delivery service, BRUTEforce® is not required to reimburse the additional amount above the least expensive standard delivery option to the extent permitted by law.
Reimbursement will be made without undue delay and generally no later than 14 days after we are informed of your decision to withdraw.
For sales contracts, reimbursement may be withheld until we receive the goods or you provide evidence that the goods have been sent back, whichever occurs first, where permitted by law.
Refunds will normally be made using the original payment method unless another method is agreed.
Any lawful diminished-value amount may be taken into account.
10. Voluntary 30-Day Money Back Guarantee
In addition to statutory rights, BRUTEforce® provides eligible customers with a 30-Day Money Back Guarantee.
This voluntary guarantee provides an additional opportunity to request an eligible change-of-mind return within 30 days of delivery, including where the statutory 14-day withdrawal period has expired.
It does not reduce, replace or restrict any mandatory consumer right.
11. Eligibility for the 30-Day Money Back Guarantee
For an eligible voluntary return:
- Contact BRUTEforce® within 30 days of receiving the product
- Provide your order number and reason for return
- Obtain return approval and an RMA before shipping
- Return the product clean and in like-new, resaleable condition
- Include supplied components, accessories and manuals
- Use original packaging wherever possible
- Return palletised products securely packaged on a suitable pallet
Ensure the product has not been materially damaged through misuse, incorrect handling or inadequate return packaging.
These requirements apply to the voluntary Money Back Guarantee and do not replace statutory withdrawal or legal rights relating to faulty or nonconforming goods.
12. 15% Restocking Fee — Voluntary Returns Only
Approved change-of-mind returns under the voluntary 30-Day Money Back Guarantee are subject to a 15% restocking fee, to the extent permitted by applicable law.
For these voluntary returns:
- The 15% restocking fee applies
- Original shipping or delivery charges are generally non-refundable
- Return freight is generally the customer's responsibility
Where BRUTEforce® arranges return freight, the actual freight cost may be deducted from the refund.
Return freight may differ from the original delivery charge.
Assembly or installation services already provided are generally non-refundable, subject to applicable law.
The 15% restocking fee does not apply merely because you exercise the statutory 14-day withdrawal right.
It does not apply to a mandatory legal remedy for faulty, damaged, incorrect or nonconforming goods.
13. Voluntary Return Refunds
Once a voluntary return has been received, please allow approximately 3–5 business days for inspection and processing.
Approved refunds will normally be issued to the original payment method.
Additional processing time may be required by your bank, card issuer or payment provider.
The refund may be subject to the applicable 15% restocking fee, return freight and other deductions permitted under the voluntary guarantee and applicable law.
14. Faulty, Damaged, Incorrect or Nonconforming Goods
Statutory withdrawal and the voluntary Money Back Guarantee are separate from your rights where goods are faulty, damaged, incorrect, incomplete, not as described or otherwise not in conformity with the contract.
A legitimate lack-of-conformity claim is not treated merely as a voluntary change-of-mind return.
The 15% voluntary restocking fee does not apply to a mandatory legal remedy for nonconforming goods.
15. EU Legal Guarantee
EU consumers have mandatory legal rights where goods do not conform to the sales contract.
New consumer goods are generally protected by a legal guarantee for at least two years from delivery, while national law may provide additional or longer protection.
Depending on the circumstances and applicable law, remedies may include repair, replacement, proportionate price reduction or termination of the contract and reimbursement.
Where applicable law requires a remedy to be provided free of charge, BRUTEforce® will not impose costs the law requires the seller to bear.
The BRUTEforce® commercial Warranty Policy is additional to these statutory rights.
16. Freight Damage
If your product arrives damaged, please contact BRUTEforce® as soon as reasonably practicable.
Where possible:
- Photograph the packaging
- Photograph visible freight damage
- Check the number of packages
- Record visible damage with the carrier where the carrier's process permits
- Retain packaging
- Photograph damaged equipment or components
- These steps assist with assessment and freight claims
Failure to photograph or immediately report freight damage does not automatically remove mandatory legal rights.

Do I have a 14-day right to return an online purchase?

Where permitted by law and properly disclosed before purchase, the customer bears the direct return cost.

- What if my product is faulty?
Faulty or nonconforming goods are not treated simply as voluntary change-of-mind returns.
Contact BRUTEforce® so the issue can be assessed under applicable consumer law and warranty provisions.
What is the EU legal guarantee?
EU consumers generally have a legal guarantee of at least two years for goods that do not conform to the sales contract, subject to applicable national law.
This is separate from the BRUTEforce® Commercial Warranty.
What warranty does a Functional Trainer have?

Lifetime applies to the eligible Structural Frame where the applicable product warranty states Lifetime.
Other components have their individual warranty periods.
What proof of purchase do I need?
A receipt, invoice, order confirmation or other acceptable proof of purchase may be used.
Is normal wear covered?
Normal deterioration caused by ordinary use is generally not a manufacturing defect under the voluntary warranty.
Mandatory statutory rights remain unaffected.
Does modifying my machine automatically void the entire warranty?
Not necessarily.
Voluntary warranty coverage may be denied to the extent an unauthorised modification, repair or non-approved component caused or contributed to the relevant defect or failure.
Can I use BRUTEforce® equipment outdoors?
Unless a product is specifically designed and advertised for outdoor use, it is intended for a suitable indoor environment.
Environmental damage caused by rain, moisture, humidity, salt air, condensation or corrosive conditions may fall outside the voluntary warranty.
How heavy is delivery?
Some large BRUTEforce® products are transported in crates weighing approximately 200–400 kg, depending on product and configuration.
Customers should ensure suitable delivery access and unloading arrangements.
Will the freight driver carry the equipment inside?
Standard freight delivery generally does not include carrying equipment into the property, moving it upstairs or assembling it unless an enhanced service has specifically been arranged.
What should I do if freight arrives damaged?
Photograph the packaging and visible damage, retain packaging and contact BRUTEforce® as soon as reasonably practicable.
This documentation helps with assessment, but failure to immediately document concealed damage does not automatically remove mandatory consumer rights.
