Terms & Conditions

The terms that apply when you buy from the BRUTEforce® the European Union store.

1. About BRUTEforce®

These Terms govern use of the BRUTEforce® website and eligible purchases from BRUTEforce® Australia for delivery into the European Union.

“BRUTEforce®”, “we”, “us” and “our” refer to BRUTEforce® Australia and the applicable operating entity.

“You” and “customer” refer to the person using the website or purchasing products.

A mandatory legal requirement prevails over an inconsistent contractual provision.

3. Website Use

You may use the website only for lawful purposes.

You must not engage in fraud, malicious interference, unauthorised access, harmful code distribution, impersonation, unauthorised commercial copying or other unlawful activity.

4. Products, Specifications & Images

BRUTEforce® makes reasonable efforts to ensure product descriptions, dimensions, specifications and images are accurate.

Minor variations may occur because of photography, displays, manufacturing tolerances, finish variations or legitimate product improvements.

Material changes will be handled in accordance with applicable law.

5. Product Safety Information

Customers must follow supplied assembly, installation, operating, maintenance and safety instructions.

Do not use equipment that appears damaged or unsafe.

Children and persons requiring supervision should not use fitness equipment unsupervised.

Published weight and operating limits must be observed.

6. EU Product Information

For products offered to EU consumers, applicable product listings will provide the product-identification, manufacturer, EU responsible-person and safety information required by applicable EU product-safety legislation.

Product-specific warnings and safety instructions form part of the information supplied with the relevant product.

7. Availability

Products are subject to availability.

An item appearing online does not guarantee stock availability until an order has been accepted.

Where BRUTEforce® cannot fulfil an accepted order, applicable refund and consumer rights will be honoured.

8. Prices

Prices applicable to EU customers will be displayed in accordance with applicable pricing and tax requirements.

Any additional delivery charge payable before purchase will be disclosed before the customer becomes bound by the order.

Where a clear pricing error occurs, BRUTEforce® will handle the matter in accordance with applicable law.

9. Orders

Submitting an order is an offer to purchase.

BRUTEforce® may decline an order where reasonably justified, including because of unavailable stock, payment failure, suspected fraud, delivery restrictions or an obvious error.

Nothing permits BRUTEforce® to cancel an accepted order contrary to mandatory consumer law.

10. Payment

Payment must be made using an available payment method.

Third-party payment providers may apply their own terms and privacy practices.

BRUTEforce® does not receive commission on government taxes or other amounts not retained as product revenue where relevant to its affiliate arrangements.

11. Promotions & Discounts

Promotions are subject to their stated terms.

Unless expressly stated otherwise, discount codes, special pricing, freight concessions and other promotions cannot automatically be combined.

12. Delivery

Delivery is governed by the EU Shipping Policy.

Customers must provide accurate delivery information and disclose relevant access restrictions.

13. Statutory Withdrawal

Eligible consumers generally have a 14-day statutory withdrawal right for distance purchases.

14. Voluntary Returns

BRUTEforce® additionally offers an eligible 30-Day Money Back Guarantee.

A 15% restocking fee applies to approved voluntary change-of-mind returns to the extent permitted by law.

It does not apply simply because a consumer exercises the statutory 14-day withdrawal right.

15. Faulty & Nonconforming Goods

Faulty, damaged, incorrect or nonconforming goods are handled separately from voluntary change-of-mind returns.

Mandatory statutory remedies remain available.

16. Commercial Warranty

The BRUTEforce® Commercial Warranty provides additional product-specific coverage.

It does not replace the EU legal guarantee of conformity.

17. Assembly & Installation

Customers are responsible for correct assembly and installation unless an agreed professional installation service is supplied.

Incorrect assembly may affect voluntary warranty coverage where it caused or contributed to the failure.

18. Maintenance

Customers should carry out maintenance specified in the relevant instructions, including inspection, cleaning, adjustment and lubrication where applicable.

19. Intellectual Property

BRUTEforce® trademarks, logos, product photography, video, graphics, product descriptions, written material, website design and other proprietary content are owned by or licensed to BRUTEforce® unless otherwise stated.

Unauthorised commercial reproduction or exploitation is prohibited.

20. Reviews & User Content

Content submitted to BRUTEforce® must be lawful, truthful and not misleading.

Reviews presented as customer experiences must reflect genuine experiences.

BRUTEforce® does not require a positive sentiment as a condition of an incentive.

Any material connection between a reviewer or endorser and BRUTEforce® must be clearly disclosed where required.

21. Third-Party Services

Third-party websites, payment providers and services operate under their own terms and policies.

Nothing in this clause removes responsibility that BRUTEforce® cannot lawfully exclude.

22. Website Accuracy & Availability

BRUTEforce® may correct website errors and update information.

Where an error materially affects an accepted order, the issue will be handled in accordance with applicable law.

Temporary website interruption may occur because of maintenance, technical issues, cybersecurity events or other circumstances.

23. Liability

Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

To the extent permitted by applicable law, BRUTEforce® is not responsible for loss caused solely by customer misuse, failure to follow instructions, unauthorised modifications or repairs, inadequate maintenance, use outside published specifications or other conduct for which BRUTEforce® is not legally responsible.

24. Events Outside Reasonable Control

BRUTEforce® is not responsible for delay caused by circumstances outside its reasonable control to the extent permitted by law.

Mandatory rights to refunds, termination or other remedies remain unaffected.

25. Changes to These Terms

BRUTEforce® may update these Terms for future website use and future transactions.

A later change will not retrospectively remove contractual or statutory rights attached to an existing purchase except where legally permitted or required.

26. Severability

If a provision is invalid or unenforceable, it will be interpreted or modified to the minimum extent necessary where legally possible.

The remaining provisions continue to apply.

27. Governing Law & EU Consumer Rights

These Terms may provide for the law applicable to BRUTEforce® Australia, but no choice-of-law provision is intended to deprive an EU consumer of mandatory protection available under the law that would otherwise apply to that consumer.

Nothing in these Terms requires a consumer to surrender a mandatory right to bring proceedings in a competent court available under applicable law.

28. Legal Capacity

By placing an order, you confirm that you are legally capable of entering into the relevant agreement.

A person purchasing for a business or organisation confirms that they have appropriate authority.
